Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Ps and Qs platform at ps-and-qs.com (the “Platform”) and the B.O.T. (Be On Time) shift-alert SMS program (together with the Platform, the “Services”), each operated by Hammer & Nails Grooming Shop of Greenwich (“Hammer & Nails,” “we,” “us,” or “our”).

By accessing or using the Services, or by replying “YES” to our opt-in SMS message, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

The Services are available only to authorized team members, owners, and administrators of Hammer & Nails Grooming Shop of Greenwich and its affiliated shops. You must be at least sixteen (16) years old to use the Services.

2. Accounts

Access to the Platform is by invitation from an authorized administrator. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately if you suspect unauthorized use.

3. B.O.T. SMS shift-alert program

The B.O.T. program sends time-of-shift alerts by SMS to enrolled team members, using their home address and live traffic data to estimate when they should leave home to arrive on time. By opting in, you agree to the following:

Program description.B.O.T. is a shift-alert SMS program operated by Hammer & Nails for its team members.
Opt-in. You may opt in by signing an opt-in form at the shop or by replying YES to our initial invitation text. Consent to receive SMS messages is not a condition of employment.
Message frequency. You can expect to receive up to two (2) messages per scheduled shift (a heads-up message and a go-time message), plus occasional service messages related to the program itself. Actual frequency varies with your schedule.
Cost.Message and data rates may apply. Message and data rates are set by your mobile carrier and are not charged by Hammer & Nails.
Opt-out. Reply STOP to any B.O.T. message to unsubscribe at any time. You will receive one confirmation message and no further B.O.T. messages unless you later opt back in.
Help. Reply HELP to any B.O.T. message for assistance, or contact us at brenda@hngrooming.com.
Supported carriers. The program is available on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
No guarantee of delivery or timing. Traffic estimates and message delivery depend on third-party services and network conditions. We do not guarantee that a message will be delivered, that it will be delivered at a particular time, or that a traffic estimate will be accurate. You remain responsible for arriving on time for your scheduled shifts.
Non-sharing. We do not sell, rent, share, or otherwise disclose mobile phone numbers or SMS opt-in data to third parties or affiliates for their own marketing purposes.

4. Acceptable use

You agree not to:

Use the Services in violation of any applicable law or regulation;
Access or attempt to access any account, data, or system for which you are not authorized;
Interfere with, disrupt, or attempt to gain unauthorized access to any part of the Services; or
Use the Services to send unsolicited communications or transmit malicious code.

5. Intellectual property

The Services, including all software, content, trademarks, and logos, are owned by Hammer & Nails or its licensors and are protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for their intended internal-operations purpose.

6. Third-party services

The Services rely on third-party providers, including Twilio Inc., Google LLC, Supabase Inc., Vercel Inc., and Zenoti. Your use of the Services is also subject to the terms and privacy policies of those providers where their services are exposed to you. We are not responsible for third-party services or outages.

7. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMMER & NAILS AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless Hammer & Nails from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our reasonable discretion. You may stop using the Services at any time.

11. Governing law and disputes

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Fairfield County, Connecticut, and you consent to the jurisdiction of those courts.

12. Changes

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Services after any change constitutes acceptance of the updated Terms.
